1. I fully and voluntarily consent to my participation in the Program, which includes Race access and may, at Visa’s discretion also include, without limitation, hotel accommodations, transportation, and/or other onsite activities. I hereby acknowledge my awareness that participation in the Program may expose me to risk of property damage, bodily or personal injury. I understand that the risks that I may encounter include, but are not limited to transportation accidents, injury from falls, injury in inclement weather, and exposure to contagious diseases which may cause death, as well as other risks that may not be foreseeable. I knowingly and freely assume any and all such risks.
2. In exchange for being allowed to participate in the Program, I hereby release and forever discharge and agree to indemnify Visa Inc., Visa U.S.A. Inc., Visa International Service Association, Visa Canada Corporation, Visa Worldwide Pte. Ltd., Visa Europe Ltd., Visa Europe Services Inc. and those entities controlling, controlled by, or under common control with, any of the foregoing, and any successors, successors in interest, and/or permitted assigns thereto, and each of their respective client financial institutions and merchants, and each of the foregoing’s parents, subsidiaries, affiliates, representatives, agents, designees, and advertising and promotion agencies, and the employees, personnel, designees, and representatives of all of the foregoing (collectively, “Visa”), Block, Inc., MKTG, Inc., and any entities controlling, controlled by, or under common control with, each of the foregoing, and any successors, successors in interest, and/or permitted assigns thereto, and the foregoing’s parents, subsidiaries, affiliates, representatives, agents, designees, and the employees, personnel, designees, and representatives of the foregoing (each, a “Visa Party” and collectively, the “Visa Parties”) and Red Bull Technology Limited, Racing Bulls S.P.A., Red Bull GmbH, Formula One Management Limited, and Federation Internationale de l’Automobile and those entities controlling, controlled by, or under common control with, any of the foregoing, and any successors, successors in interest, and/or permitted assigns thereto, and each of the foregoing’s parents, subsidiaries, affiliates, representatives, agents, designees, and advertising and promotion agencies, and the employees, personnel, designees, and representatives of all of the foregoing (each, a “Team Party” and collectively, the “Team Parties”) from any and all claims, demands, rights, expenses, actions, and causes of action, of whatever kind (collectively, “Claims”), arising from or by reason of any personal injury, bodily injury, property damage, or the consequences thereof, whether foreseeable or not, resulting from or in any way connected with my participation in the Program. I further covenant and agree that for good and valuable consideration, I will hold forever harmless and will not take legal action against any Visa Party or Team Party for any claim for damages arising or growing out of my participation in the Program whether caused by negligence or otherwise.
3. I acknowledge and agree that I am solely responsible for all preparation and precautionary measures and costs incurred relating to or in connection with my participation in the Program, including but not limited to obtaining and payment for any registrations, licenses, vaccinations, taxes, or other applicable measures or costs as applicable.
4. I acknowledge and agree that neither a Visa Party nor Team Party will be liable if, for any reason, the Program cannot be administered as planned due to events outside the reasonable control of any party, including but not limited to: (a) any cancellation or postponement of any event connected to the Program; (b) if the holding of such event without spectators will frustrate and void the Program; (c) an act of war, terrorism, civil riot or upheaval, epidemic, pandemic, quarantine requirements, embargo or similar governmental action, labor dispute, or natural disaster; (d) any errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program; or (e) the delay or change in the Program could not have been avoided even if the party unable to perform had exercised reasonable care. I acknowledge and agree that the Visa Parties and Team Parties reserve the right at the sole discretion of each to suspend, modify or terminate the Program as the result of a force majeure event.
5. I acknowledge and agree that neither a Visa Party nor Team Party will be liable for the acts or omissions of any third party service provider, vendor, contractor or subcontractor relating to or in connection with the Program, including but not limited to, airline operators, car or van transportation providers, hotels, restaurants, caterers or other third party service providers.
6. I grant to each of the Visa Parties the unlimited right and permission (but not the obligation) to: (a) film, photograph, videotape and/or record me during the Program; and (b) reproduce, publish, display, distribute, broadcast, or otherwise use the resulting recordings, films, and photographs that include my name, image, performance (if applicable), likeness, and/or voice (collectively, my “Persona”), edited or altered as any Visa Party sees fit, together with any other materials (collectively, the “Materials”), in any manner online and via social media whether now known or hereinafter invented, anywhere in the world, in perpetuity, irrevocably for any purpose, including, without limitation, for advertising Visa products or services and/or the Program. I agree that I shall have no further right of approval, no claim to compensation, and no claim arising out of any use of my Persona in the Materials.
7. I acknowledge and agree that the Visa Parties may pass on my personal information to Team Parties for the purpose of the Program.
8. This Release shall be governed by and interpreted in all respects in accordance with the substantive laws of the state of New York, without regard to its choice of law and/or conflicts of law principles. I irrevocably agree that any disputes directly or indirectly arising out of or relating to this Release shall be resolved exclusively in the state or federal courts located in New York County, New York. I hereby irrevocably consent to such venue and to the exclusive jurisdiction of any such court over any such dispute.
9. If any provision of this Release is determined to be invalid by a court of competent jurisdiction, such term or provision shall be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law and the remaining provisions or portions shall remain in full force and effect. This Release sets forth the entire agreement of the parties with respect to the subject matter hereof and supersedes any and all prior or contemporaneous oral and/or written representations, discussions, negotiations, understandings, and/or agreements relating to the subject matter hereof. This Release may not be modified except by in a writing signed by all parties. In signing this Release, I am not relying on any promises, representations or other statements that are not contained in this Release.
10. I acknowledge and agree that, once received by me, any ticket for the Race set forth above (a) cannot be replaced if lost, stolen or destroyed and is valid only for the Race on the date and time and for the seat location set forth on the ticket, (b) each ticket is granted in respect of the Race and is not transferable, refundable or subject to any substitution or make good, including if the Race does not go ahead or track time is limited or shortened, (c) tickets are not redeemable for cash, (d) resale of tickets is prohibited, (e) unauthorized use or duplication of a ticket, in whole or in part, is strictly prohibited, and (f) the Visa Parties may pass on my personal information to Team Parties for the purpose of issuing tickets.
11. In exchange for accepting a ticket and/or participating in the Program, I hereby release and forever discharge and agree to indemnify the Visa Parties and Team Parties from any and all claims, demands, rights, expenses, actions, and causes of action, of whatever kind, arising from or by reason of any personal injury, bodily injury, property damage, or the consequences thereof, whether foreseeable or not, resulting from or in any way connected with my participation in the Program, including, without limitation, my use of the ticket. I further covenant and agree that for the good and valuable consideration, the receipt of which is hereby acknowledged, I will hold forever harmless and will not take legal action against any Visa Party or Team Party for any claim for damages arising or growing out of my (and any minor’s, if applicable) participation in the Program and/or use of the ticket, whether caused by negligence or otherwise.
12. In the event I intend to accompany an individual under the age of majority in the state or country in which they reside (the “Minor”) during the program, I will execute a Minor Addendum together with this Release.
13. I WARRANT AND REPRESENT THAT I AM AT OR OVER THE AGE OF MAJORITY IN MY PLACE OF LEGAL RESIDENCE AND OVER THE AGE OF EIGHTEEN (18), THAT I HAVE THE FULL AND EXCLUSIVE RIGHT AND POWER TO ENTER INTO THIS RELEASE, AND THAT THIS RELEASE DOES NOT IN ANY WAY CONFLICT WITH ANY EXISTING COMMITMENT ON MY PART. I HEREBY AFFIRM AND ACKNOWLEDGE THAT I HAVE READ THIS RELEASE AND THAT I UNDERSTAND ITS CONTENTS AND AGREE TO BE BOUND THEREBY.

I certify that I understand and have read the above carefully before signing. I acknowledge and represent that I freely and voluntarily sign this Release, and that it is my express intent that this Release shall contractually bind my heirs, executors, administrators, and assigns, as well as myself and any minor for whom I am a guardian, as applicable.
